Rubbish Collection Merton Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Collection Merton provides rubbish and waste collection services to domestic and commercial customers. By placing a booking with us, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means any individual, company or organisation that requests or uses our waste and rubbish collection services.

Services means the waste, rubbish and junk removal, collection, loading and related services provided by Rubbish Collection Merton.

Waste means any items, materials, rubbish, junk or refuse that the Customer asks us to remove, subject to applicable waste regulations and the exclusions stated in these terms.

Contract means the agreement between Rubbish Collection Merton and the Customer for the provision of Services in accordance with these Terms and Conditions.

2. Scope of Services

Rubbish Collection Merton provides waste and rubbish collection services, including but not limited to household rubbish removal, garden waste collection, bulky item collection and light commercial waste clearance. The exact scope of each collection will be agreed at the time of booking, based on the information you provide.

All Services are subject to availability and to compliance with UK waste management laws and local authority requirements. We reserve the right to decline or postpone a collection if the Waste is not as described, is unsafe to handle, or would cause us to breach any legal obligations.

3. Booking Process

3.1 Bookings may be made by telephone or online via our booking system where available. When placing a booking, you must provide accurate and complete information, including:

a description of the Waste to be collected

the collection address and any access restrictions

preferred collection date and time window

your contact details, including a valid telephone number and email address where applicable.

3.2 Any collection date and time communicated to you is an estimate and subject to traffic, weather conditions, workload and other factors beyond our reasonable control. We will use reasonable efforts to attend within the agreed time window but do not guarantee a specific arrival time.

3.3 Your booking is accepted when we confirm it verbally, by email, or through our booking system. Once accepted, a Contract is formed between you and Rubbish Collection Merton on these Terms and Conditions.

4. Pricing and Quotations

4.1 Prices are typically based on the estimated volume, weight and type of Waste to be collected, as well as access conditions and loading time. Any prices quoted in advance are provisional and subject to confirmation on arrival at the collection address.

4.2 If, on arrival, the Waste is significantly different in quantity, type or accessibility from that described at the time of booking, we may:

adjust the price accordingly and seek your agreement before proceeding, or

decline to carry out all or part of the Service, in which case a call-out or cancellation fee may apply, as notified to you.

4.3 All prices are stated in pounds sterling and may be inclusive or exclusive of VAT, as indicated at the time of booking or quotation.

5. Payments

5.1 Payment is due in full on completion of the collection unless we agree alternative payment terms in writing. We may accept payment by cash, card or bank transfer, subject to our payment facilities at the time of service.

5.2 For commercial Customers or larger projects, we may require a deposit or pre-payment before attending the collection. Any such requirement will be communicated to you during the booking process.

5.3 If payment is not received when due, we reserve the right to charge interest on overdue amounts at the statutory rate and to recover all reasonable costs incurred in pursuing late payment, including legal and debt recovery fees.

5.4 Title to any Waste does not pass to us until full payment has been received for the relevant Service. However, you remain responsible for the Waste until we have physically loaded it onto our vehicle.

6. Customer Responsibilities

6.1 You must ensure that our team has safe, adequate and free access to the Waste at the agreed collection time. This includes arranging any necessary parking, entry codes, permits or permissions.

6.2 The Waste must be clearly identified and separated where possible. You are responsible for removing any items that you do not wish to be taken away.

6.3 You must notify us in advance if any of the Waste includes hazardous, restricted or specialist materials, such as asbestos, chemicals, oils, clinical waste, gas cylinders or electrical equipment requiring special handling. Failure to do so may result in additional charges or cancellation of the Service.

6.4 If our team reasonably believes that it is unsafe to proceed due to health and safety concerns, dangerous materials, aggressive behaviour, or uncontrolled pets, we may refuse or suspend the Service and charge a reasonable call-out or waiting fee.

7. Cancellations and Amendments

7.1 You may cancel or amend your booking by contacting us directly. To avoid charges, you must provide us with at least 24 hours notice before the scheduled collection time.

7.2 If you cancel or significantly amend your booking with less than 24 hours notice, we may charge a cancellation fee to cover our reasonable costs, including scheduling, travel and staff time. The amount of the fee will be notified to you at the time of booking or cancellation.

7.3 If we are unable to carry out the Service due to circumstances beyond our reasonable control, such as severe weather, vehicle breakdown, accidents, or other events of force majeure, we may reschedule the collection without liability, and we will agree a new collection time with you.

7.4 We reserve the right to cancel the Contract at any time, with immediate effect, if you breach these Terms and Conditions, fail to provide safe access, fail to provide truthful information about the Waste, or behave abusively or unlawfully towards our staff.

8. Waste Regulations and Environmental Compliance

8.1 Rubbish Collection Merton operates in accordance with relevant UK waste management legislation, including duties of care for handling, transporting and disposing of controlled waste. We aim to reuse and recycle materials wherever reasonably practicable.

8.2 By engaging our Services, you confirm that you are the owner of the Waste or have the full authority of the owner to arrange for its removal and disposal. You further confirm that the Waste does not contain prohibited or illegal items and that its removal will not cause us to breach any laws or third-party rights.

8.3 Some waste streams are subject to special handling, transfer and disposal requirements, such as electrical and electronic equipment, refrigerators, tyres, paint, batteries and hazardous substances. Additional charges may apply if such items are included in the Waste. We may refuse to collect certain materials if we are not licensed or equipped to deal with them.

8.4 Once the Waste has been loaded onto our vehicle, we take responsibility for transporting and disposing of it at authorised facilities in compliance with waste regulations. You agree that we may sort, segregate, reuse, recycle or dispose of the Waste in such manner as we consider appropriate and lawful.

9. Liability and Insurance

9.1 We will carry out the Services with reasonable skill and care, taking sensible precautions to avoid damage to your property while removing Waste. However, you acknowledge that some risk of minor damage is inherent in the loading and handling of bulky or heavy items, especially in confined spaces.

9.2 We hold appropriate public liability cover for our operations. Our liability to you for any direct loss or damage arising from our negligence or breach of Contract is limited to the lesser of the total price paid for the relevant Service or the amount recoverable under our insurance, except where the law does not allow such limitation.

9.3 We are not liable for:

any loss or damage arising from inaccurate or incomplete information provided by you

indirect or consequential losses, including loss of income, profit, opportunity or reputation

damage to items or property that you have not removed or adequately protected prior to the collection, where such damage could reasonably have been avoided

any delays or failures to perform caused by events beyond our reasonable control.

9.4 You must notify us in writing of any claim for loss or damage within 7 days of the relevant collection. We may need to inspect the damage and require reasonable cooperation from you in investigating the matter.

10. Access, Parking and Permits

10.1 You are responsible for ensuring that suitable parking is available for our vehicles at or near the collection address. This includes arranging any visitor permits, pay and display fees, or other authorisations as necessary.

10.2 If parking is not available, restricted, or results in fines or penalties during the collection, you may be liable for any additional costs, charges or penalties incurred by us as a result.

10.3 We are not responsible for delays or failure to complete the collection where we are unable to park or gain access due to circumstances outside our control.

11. Health and Safety

11.1 We operate in line with relevant health and safety laws and guidelines. Our staff may refuse to lift or carry items that they consider unsafe due to excessive weight, poor condition, contamination or other hazards.

11.2 You must not ask our team to carry out any task that falls outside the agreed scope of Services, is unsafe, or would expose them to unreasonable risk.

11.3 We may use manual handling equipment or other tools where required. You agree to allow us to use such equipment on your premises, provided we take reasonable care to avoid damage.

12. Complaints and Dispute Resolution

12.1 If you are dissatisfied with any aspect of our Service, you should contact us as soon as possible, providing full details of your concern. We will investigate and respond within a reasonable timeframe.

12.2 We aim to resolve complaints amicably and may, at our discretion, offer a partial refund, price reduction or re-visit where appropriate and proportionate to the circumstances.

12.3 If a dispute cannot be resolved directly, either party may pursue their rights through the courts in accordance with the governing law clause below.

13. Data Protection and Privacy

13.1 We collect and process personal data, such as contact details and address information, for the purpose of managing bookings, delivering Services, handling payments and complying with legal obligations.

13.2 We will take reasonable steps to safeguard your personal information and will not sell or disclose it to third parties except where necessary to provide the Service, process payments, recover debts or comply with the law.

14. Variations to These Terms

14.1 We may update or amend these Terms and Conditions from time to time to reflect changes in our operations, legal requirements or industry practice. Any new version will apply to bookings placed after the updated terms are published or otherwise notified to you.

14.2 The Terms and Conditions in force at the time you make your booking will apply to that booking, unless we agree otherwise in writing.

15. Severability

15.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of Services by Rubbish Collection Merton.
